Small property housing, a dilemma for the Government
According to the report, Vice Minister of Ministry of Land and Resource Yun Xiaosu said on June 25th, whether constructed on the cultivated land or not, the commercial housing constructed on the rural collective-owned lands without approval and procedures of transference and levy are all illegal.
Before this, the Disposal Decision of Illegal construction Leftover by History Regarding to the Rural Urbanization used to be mistaken by many people for the “order of legalization”. However, the Ministry of Land and Resource said Shenzhen is disposing the illegal constructions on state-owned lands, which has essential differences with the other “small property housing” constructed illegally on rural collective-owned lands and sold or rented to the public. The reporting of Medias about Shenzhen to issue the first certificate for the “small property housing” is a misunderstanding of the “Decision”.
Yun Xiaosu said the Center had issued many documents emphasizing and requesting the ministries of lands and resources of different levels to control the stop selling the small property housing in process and not sold. But there were still some people who were risking buying. Due to different situations in different areas, the leftover small property housing should be disposed fairly and reasonably according to the law based on the particular case of each building after researched.
Yun Xiaosu also said the small property housing were actually illegal constructions without property rights and should be carefully disposed according to the law. However, some analysts considered that this actually meant the Center was stranded with this problem and had to transfer this problem to the local governments.
