ZTE Filed Lawsuit against Huawei for Patent Infringement

The patent dispute between the two national large communication equipment companies, ZTE and Huawei, were started again after a while of silence. According to relevant person of ZTE Communication yesterday, the Company had filed a lawsuit against Huawei at Shenzhen Intermediate People’s Court, accusing that Huawei had infringed three of its LTE patents.

ZTE filed a proceeding application to Shenzhen Intermediate People’s Court one month ago for Huawei’s LTE patent infringement, but the Court did not accept the case at once. At the end of last month, ZTE Communication sent the petition to Huawei and made the suit enter into judicial flow. The requirements in the petition filed by ZTE included making Huawei stop immediately manufacturing and using TD-LTE system equipments and forbidding Huawei to develop the technical tests on TD-LTE.

The lawsuit that ZTE filed this time was actually a counterattack against Huawei’s prosecution against ZTE in Europe. On April 28, Huawei filed lawsuits against ZTE in Germany, France and Hungary accusing that ZTE infringed its data cards and LTE patent rights and German court approved its petition by issuing temporary ban to ZTE. As a response, ZTE also carried out a series of activities, such as the lawsuit filed this time in China.
